Terms of Service

These Terms of Service ("Terms") govern your access to and use of Soft37 (the "App"), developed and operated by Soft37. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

Subject to your full compliance with these Terms, Soft37 grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial purposes.

2. License Restrictions

You may not, and you may not permit others to:

  • Copy, modify, distribute, sell, sublicense, or lease any part of the App or its content.
  • Reverse engineer, disassemble, decompile, or attempt to extract the source code of the App.
  • Remove, obscure, or alter any proprietary rights notices within the App.
  • Use the App to create a competing product or service.
  • Use automated tools (bots, scrapers, crawlers) to access the App's systems or APIs without express written consent.

3. User Obligations & Prohibited Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You are strictly prohibited from:

  • Attempting to hack, penetrate, or disrupt the App's servers, infrastructure, or network.
  • Accessing or attempting to access accounts, data, or systems belonging to other users without authorization.
  • Transmitting viruses, malware, ransomware, or any other harmful or malicious code.
  • Engaging in fraud, impersonation, phishing, or any form of misrepresentation.
  • Circumventing, disabling, or otherwise interfering with any security feature or access control.
  • Using the App in any manner that could damage, overburden, or impair its functionality.

Violation of these restrictions may result in immediate account suspension or permanent termination without prior notice, at our sole discretion.

4. Subscription & Payment

Certain features of the App require a paid subscription. All purchases and subscriptions are processed exclusively through Apple App Store or Google Play Store (the "Store"), depending on your device platform.

  • Subscription pricing, billing intervals, and free trial terms are displayed in the App and the applicable Store listing.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage and cancel your subscription at any time through your Apple ID or Google account settings.
  • We do not directly process, handle, or store any payment or billing information. All such data is managed exclusively by the applicable Store.
  • Subscription fees may vary by region and are subject to change, consistent with the Store's policies.

5. Refund Policy

All refund requests must be submitted directly to Apple App Store or Google Play Store in accordance with their respective refund policies. We do not have the ability to issue refunds directly. By making a purchase, you acknowledge and agree that refund eligibility is determined solely by the applicable Store.

6. Intellectual Property

The App and all of its content, features, and functionality — including but not limited to software, text, graphics, logos, and audio — are and remain the exclusive property of Soft37 and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Soft37 EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Soft37, ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF DATA OR DATA BREACHES; SERVICE INTERRUPTIONS OR OUTAGES; FINANCIAL OR EMOTIONAL HARM RESULTING FROM SERVICE ERRORS OR MALFUNCTIONS; OR LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES — EVEN IF Soft37 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Soft37 and its affiliates from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the App; (b) your violation of these Terms; or (c) your violation of any third-party right.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms or the App that cannot be resolved through good-faith negotiation shall be submitted to binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm. The prevailing language of these Terms for legal interpretation purposes is English.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms with a new effective date within the App or via email. Your continued use of the App after the effective date constitutes your acceptance of the revised Terms.

12. Termination

We reserve the right to suspend or permanently terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App ceases immediately. Sections 6–10 survive termination.

1. ライセンスの付与

本規約を完全に遵守することを条件として、Soft37はお客様に対し、お客様が所有または管理するデバイス上で個人的・非商業的目的に限り本アプリをインストールおよび使用するための、限定的・非独占的・譲渡不可・取消可能なライセンスを付与します。

2. ライセンスの制限

お客様は以下の行為をすることができず、また第三者にそれを許可することもできません：

  • 本アプリまたはそのコンテンツの複製・改変・配布・販売・サブライセンス・貸与
  • 本アプリのリバースエンジニアリング・逆アセンブル・逆コンパイル・ソースコードの抽出の試み
  • 本アプリ内の知的財産権に関する表示の削除・隠蔽・改変
  • 競合製品またはサービスを作成する目的での本アプリの利用
  • 書面による明示的な同意なく、ボット・スクレイパー等の自動化ツールによる本アプリのシステムやAPIへのアクセス

3. 利用者の義務および禁止行為

お客様は本アプリを合法的な目的のみに使用することに同意します。以下の行為は厳に禁止されます：

  • 本アプリのサーバー、インフラ、ネットワークへのハッキング・侵入・妨害の試み
  • 他の利用者のアカウント、データ、システムへの無断アクセスまたはその試み
  • ウイルス、マルウェア、ランサムウェア等の有害なコードの送信
  • 詐欺、なりすまし、フィッシング、その他の不実表示への関与
  • セキュリティ機能またはアクセス制御の回避・無効化・妨害
  • 本アプリの機能に損害を与え、過負荷をかけ、または障害を生じさせる方法での利用

上記制限に違反した場合、当社の単独の裁量により、事前通知なく即座にアカウントを停止または永久に終了させる場合があります。

4. サブスクリプションと支払い

本アプリの一部機能は有料サブスクリプションを必要とします。すべての購入およびサブスクリプションは、デバイスのプラットフォームに応じてApple App StoreまたはGoogle Play Store（以下「ストア」）を通じてのみ処理されます。

  • サブスクリプションの価格、請求間隔、無料トライアル条件は本アプリおよび各ストアの掲載ページに表示されます。
  • 現在の請求期間終了の少なくとも24時間前にキャンセルされない限り、サブスクリプションは自動的に更新されます。
  • Apple IDまたはGoogleアカウントの設定から、いつでもサブスクリプションを管理・キャンセルできます。
  • 当社は支払い情報または請求情報を直接処理・取り扱い・保存しません。これらはすべて各ストアが管理します。
  • サブスクリプション料金は地域によって異なる場合があり、ストアのポリシーに従って変更される場合があります。

5. 返金ポリシー

すべての返金請求は、Apple App StoreまたはGoogle Play Storeの各返金ポリシーに従い、直接各ストアに申請する必要があります。当社は直接返金を行う権限を持ちません。購入することにより、返金の可否は各ストアのみが決定することを承認し同意したものとみなします。

6. 知的財産権

本アプリおよびそのコンテンツ、機能、ソフトウェア、テキスト、グラフィック、ロゴ、音声等はすべてSoft37の独占的な財産であり、適用される知的財産法によって保護されています。本規約はいかなる所有権もお客様に移転するものではありません。

7. 保証の免責

本アプリは「現状のまま（AS IS）」および「利用可能な状態で（AS AVAILABLE）」提供され、明示または黙示を問わず、いかなる種類の保証もありません。適用法令が許す最大限の範囲において、Soft37は商品性、特定目的への適合性、非侵害性に関する保証を含む一切の保証を明示的に否認します。本アプリが中断なく、エラーなく、安全に、またはウイルスその他の有害な要素なく提供されることを保証しません。

8. 責任の制限

適用法令が許す最大限の範囲において、Soft37は、データ損失、データ漏洩、サービスの中断・停止、サービスのエラーや誤動作による経済的・精神的損害、または収益・ビジネス機会の喪失を含むがこれに限らない、間接的・偶発的・特別・結果的・懲罰的損害に対して、たとえかかる損害の可能性について事前に通知を受けていたとしても、一切の責任を負いません。クレームが発生した前の12ヶ月間にお客様が支払った合計金額を超える責任を当社は負わないものとします。

9. 補償

お客様は、(a)本アプリの利用または誤用、(b)本規約への違反、(c)第三者の権利への侵害に起因または関連するあらゆるクレーム、責任、損害、判決、損失、費用（合理的な弁護士費用を含む）からSoft37を免責し、防御し、補償することに同意します。

10. 準拠法および紛争解決

本規約は適用法令に準拠して解釈されます。本規約または本アプリに関連して生じた紛争で誠実な交渉によって解決できないものは、拘束力のある仲裁に付されるものとします。ただし、回復不能な損害を防止するため、いずれの当事者も管轄裁判所に差止命令による救済を申請することができます。法的解釈における本規約の優先言語は英語とします。

11. 規約の変更

当社はいつでも本規約を変更する権利を留保します。重要な変更については、新しい施行日を付した更新規約をアプリ内またはメールで通知します。施行日以降のアプリ継続利用は改定規約への同意とみなします。

12. 利用の終了

当社はいつでも、理由の有無にかかわらず、通知の有無にかかわらず、お客様の本アプリへのアクセスを停止または永久に終了させる権利を留保します。終了した時点で、本アプリを使用するライセンスは直ちに消滅します。第6条〜第10条は終了後も存続します。

1. 이용 권한 부여 (라이선스)

이용자가 본 약관을 완전히 준수하는 것을 조건으로, Soft37은 이용자에게 이용자가 소유하거나 관리하는 기기에서 개인적·비상업적 목적으로만 앱을 설치하고 사용할 수 있는 제한적·비독점적·양도 불가·취소 가능한 라이선스를 부여합니다.

2. 라이선스 제한

이용자는 다음의 행위를 하거나 제3자가 하도록 허용할 수 없습니다:

  • 앱 또는 그 콘텐츠의 복제, 수정, 배포, 판매, 재사용 허락, 대여
  • 앱의 리버스 엔지니어링, 역어셈블, 디컴파일, 소스 코드 추출 시도
  • 앱 내 지식재산권 관련 표시의 삭제, 은폐, 변경
  • 경쟁 제품 또는 서비스 제작을 목적으로 한 앱 이용
  • 서면 동의 없이 봇, 스크레이퍼 등 자동화 도구를 이용한 앱 시스템 또는 API 접근

3. 이용자의 의무 및 금지행위

이용자는 합법적인 목적으로만 앱을 이용하는 데 동의합니다. 다음 행위는 엄격히 금지됩니다:

  • 앱의 서버, 인프라, 네트워크에 대한 해킹·침투·방해 시도
  • 다른 이용자의 계정, 데이터, 시스템에 대한 무단 접근 또는 시도
  • 바이러스, 악성코드, 랜섬웨어 등 유해한 코드 전송
  • 사기, 사칭, 피싱, 기타 허위 표시 행위
  • 보안 기능 또는 접근 제어의 우회·비활성화·방해
  • 앱의 기능을 손상시키거나 과부하를 초래하는 방식으로의 이용

위 제한 사항을 위반할 경우, 당사의 단독 재량에 따라 사전 통지 없이 즉시 계정 정지 또는 영구 이용 제한 조치가 취해질 수 있습니다.

4. 구독 및 결제

앱의 일부 기능은 유료 구독을 필요로 합니다. 모든 구매 및 구독은 이용자의 기기 플랫폼에 따라 Apple App Store 또는 Google Play Store（이하 "스토어"）를 통해서만 처리됩니다.

  • 구독 가격, 결제 주기, 무료 체험 조건은 앱 및 해당 스토어 페이지에 표시됩니다.
  • 현재 결제 기간 종료 최소 24시간 전에 취소하지 않으면 구독은 자동 갱신됩니다.
  • Apple ID 또는 Google 계정 설정에서 언제든지 구독을 관리하거나 해지할 수 있습니다.
  • 당사는 결제 정보 또는 청구 정보를 직접 처리·취급·저장하지 않으며, 해당 정보는 전적으로 각 스토어에서 관리합니다.
  • 구독 요금은 지역에 따라 상이할 수 있으며, 스토어 정책에 따라 변경될 수 있습니다.

5. 환불 정책

모든 환불 요청은 Apple App Store 또는 Google Play Store의 각 환불 정책에 따라 해당 스토어에 직접 신청해야 합니다. 당사는 직접 환불을 처리할 권한이 없습니다. 구매함으로써 이용자는 환불 가부가 전적으로 해당 스토어에 의해 결정됨을 인지하고 동의합니다.

6. 지식재산권

앱 및 모든 콘텐츠, 기능, 소프트웨어, 텍스트, 그래픽, 로고, 음향 등은 Soft37의 독점적 재산이며, 관련 지식재산권 법령의 보호를 받습니다. 본 약관은 이용자에게 어떠한 소유권도 이전하지 않습니다.

7. 보증의 부인 (Disclaimer of Warranties)

앱은 관련 법령이 허용하는 최대 범위 내에서 어떠한 명시적·묵시적 보증도 없이 "현재 상태 그대로(AS IS)" 및 "이용 가능한 상태로(AS AVAILABLE)" 제공됩니다. Soft37은 상품성, 특정 목적 적합성, 비침해성에 관한 보증을 포함하여 일체의 보증을 명시적으로 부인합니다. 앱이 중단 없이, 오류 없이, 안전하게, 또는 바이러스 등 유해한 요소 없이 제공됨을 보증하지 않습니다.

8. 책임의 제한 (Limitation of Liability)

관련 법령이 허용하는 최대 범위 내에서, Soft37은 데이터 손실·유출, 서비스 중단·장애, 시스템 오류 또는 오작동으로 인한 이용자의 경제적·정신적 손해, 수익·비즈니스 기회의 손실을 포함하나 이에 한정되지 않는 간접적·우발적·특별·결과적·징벌적 손해에 대하여, 당사가 그러한 손해의 가능성을 사전에 통보받았더라도 일체의 책임을 지지 않습니다. 당사의 총 책임은 클레임 발생 전 12개월 동안 이용자가 당사에 지불한 총액을 초과하지 않습니다.

9. 면책 (Indemnification)

이용자는 (a) 앱의 이용 또는 남용, (b) 본 약관 위반, (c) 제3자 권리 침해로 인하거나 이와 관련하여 발생하는 모든 클레임, 책임, 손해, 판결, 손실, 비용（합리적인 변호사 비용 포함）으로부터 Soft37을 면책하고, 방어하며, 보상하는 데 동의합니다.

10. 준거법 및 분쟁 해결

본 약관은 관련 법령에 따라 해석됩니다. 성실한 협상으로 해결되지 않는 본 약관 또는 앱에 관련한 분쟁은 구속력 있는 중재에 의해 해결됩니다. 다만, 회복 불가능한 손해를 방지하기 위해 당사자 일방은 관할 법원에 금지 명령 구제를 신청할 수 있습니다. 법적 해석에 있어 본 약관의 우선 언어는 영어입니다.

11. 약관의 변경

당사는 언제든지 본 약관을 변경할 권리를 보유합니다. 중요한 변경 사항은 앱 내 또는 이메일을 통해 새로운 시행일이 부기된 개정 약관을 공지합니다. 시행일 이후 앱 계속 이용 시 개정 약관에 동의한 것으로 간주합니다.

12. 이용 종료 및 계정 제재

당사는 언제든지, 이유의 유무와 통지의 유무에 관계없이, 이용자의 앱 접근을 정지하거나 영구 이용 제한할 권리를 보유합니다. 이용이 종료되면 앱 사용 라이선스는 즉시 소멸합니다. 제6조~제10조는 이용 종료 후에도 효력이 유지됩니다.

3. 用户义务及禁止行为

您同意仅将本应用用于合法目的，并遵守本条款。以下行为被严格禁止：

  • 尝试入侵、渗透或破坏本应用的服务器、基础设施或网络
  • 未经授权访问或尝试访问其他用户的账户、数据或系统
  • 传播病毒、恶意软件、勒索软件或任何其他有害代码
  • 从事欺诈、假冒、网络钓鱼或任何形式的虚假陈述
  • 规避、禁用或干扰任何安全功能或访问控制措施
  • 以任何可能损害、过载或削弱本应用功能的方式使用

违反上述限制可能导致我们自行决定立即暂停或永久终止您的账户，恕不提前通知。

4. 订阅与付款

本应用的某些功能需要付费订阅。所有购买和订阅均通过Apple App Store或Google Play Store（以下简称"商店"）独家处理。

  • 订阅价格、计费周期和免费试用条款显示在本应用及相应商店页面中。
  • 订阅将自动续订，除非在当前计费周期结束前至少24小时取消。
  • 您可以随时通过Apple ID或Google账户设置管理和取消订阅。
  • 我们不直接处理、处理或存储任何付款或计费信息，所有此类数据均由相应商店独家管理。
  • 订阅费用可能因地区而异，并可能按照商店政策变更。

5. 退款政策

在适用法律允许的最大范围内，本应用以"现状"和"可用状态"提供，不附带任何明示或暗示的保证。Soft37明确否认所有保证，包括但不限于对适销性、特定用途适用性和不侵权的保证。我们不保证本应用不间断、无错误、安全运行或不含病毒等有害组件。

8. 责任限制

在适用法律允许的最大范围内，Soft37对任何间接、偶然、特殊、后果性或惩罚性损害不承担任何责任，包括但不限于：数据丢失或数据泄露、服务中断或停机、因服务错误或故障造成的经济或精神损害、利润或商业机会损失——即使Soft37已被告知此类损害的可能性。我们对您就本应用或本条款提出的所有索赔的总累计责任不超过您在索赔前十二（12）个月内向我们支付的总金额。

9. 赔偿

您同意就以下情况产生的任何索赔、责任、损害、判决、损失、费用（包括合理律师费）对Soft37进行赔偿、辩护并使其免受损害：(a) 您对本应用的使用或滥用；(b) 您违反本条款；(c) 您侵犯任何第三方权利。

10. 适用法律与争议解决

本条款依据适用法律解释和执行。因本条款或本应用引起且无法通过善意协商解决的争议，应提交有约束力的仲裁，但任何一方均可向有管辖权的法院申请禁令救济以防止不可弥补的损害。本条款法律解释的优先语言为英语。

11. 条款变更

我们保留随时修改本条款的权利。我们将通过在应用内或通过电子邮件发布带有新生效日期的更新条款来通知您重大变更。在生效日期后继续使用本应用即表示您接受修订后的条款。

12. 终止

我们保留随时以任何理由，无论是否提前通知，暂停或永久终止您访问本应用的权利。终止后，您使用本应用的许可立即停止。第6至10条在终止后继续有效。

1. Lizenzgewährung

2. Lizenzbeschränkungen

Sie dürfen nicht und dürfen anderen nicht erlauben:

  • Teile der App oder ihrer Inhalte zu kopieren, zu modifizieren, zu verteilen, zu verkaufen, unterzulizenzieren oder zu vermieten
  • Die App zurückzuentwickeln, zu disassemblieren, zu dekompilieren oder den Quellcode zu extrahieren
  • Eigentumsrechtshinweise in der App zu entfernen, zu verbergen oder zu ändern
  • Die App zur Entwicklung eines konkurrierenden Produkts oder Dienstleistung zu nutzen
  • Ohne ausdrückliche schriftliche Genehmigung automatisierte Tools (Bots, Scraper) für den Zugriff auf die Systeme oder APIs der App einzusetzen

3. Nutzerpflichten und verbotene Handlungen

Sie stimmen zu, die App nur für rechtmäßige Zwecke zu verwenden. Folgende Handlungen sind ausdrücklich verboten:

  • Versuche, die Server, Infrastruktur oder das Netzwerk der App zu hacken, zu penetrieren oder zu stören
  • Unbefugter Zugriff oder Zugriffsversuche auf Konten, Daten oder Systeme anderer Nutzer

  • Betrug, Identitätsdiebstahl, Phishing oder sonstige Täuschungshandlungen
  • Umgehung, Deaktivierung oder Beeinträchtigung von Sicherheitsfunktionen oder Zugriffskontrollen
  • Nutzung der App in einer Weise, die ihre Funktionsfähigkeit beschädigen, überlasten oder beeinträchtigen könnte

Verstöße gegen diese Einschränkungen können nach unserem alleinigen Ermessen zur sofortigen Kontosperrung oder dauerhaften Beendigung ohne vorherige Ankündigung führen.

4. Abonnement und Zahlung

Bestimmte Funktionen der App erfordern ein kostenpflichtiges Abonnement. Alle Käufe und Abonnements werden ausschließlich über den Apple App Store oder Google Play Store (den „Store") abgewickelt.

  • Preise, Abrechnungsintervalle und kostenlose Testzeiträume sind in der App und auf der jeweiligen Store-Seite angegeben.
  • Abonnements verlängern sich automatisch, wenn sie nicht mindestens 24 Stunden vor Ablauf der aktuellen Abrechnungsperiode gekündigt werden.
  • Sie können Ihr Abonnement jederzeit über Ihre Apple-ID- oder Google-Kontoeinstellungen verwalten und kündigen.
  • Wir verarbeiten, verwalten oder speichern keine Zahlungs- oder Abrechnungsdaten direkt — diese werden ausschließlich vom jeweiligen Store verwaltet.
  • Die Preise können je nach Region variieren und können entsprechend der Store-Richtlinien angepasst werden.

5. Rückerstattungsrichtlinie

Alle Rückerstattungsanfragen sind direkt beim Apple App Store oder Google Play Store gemäß deren jeweiliger Rückerstattungsrichtlinie einzureichen. Wir können keine direkten Rückerstattungen vornehmen. Mit einem Kauf erkennen Sie an, dass die Erstattungsberechtigung ausschließlich vom jeweiligen Store bestimmt wird.

6. Geistiges Eigentum

Die App und alle ihre Inhalte, Funktionen, Software, Texte, Grafiken, Logos und Audiomaterial sind ausschließliches Eigentum von Soft37 und durch anwendbare Gesetze zum Schutz des geistigen Eigentums geschützt. Diese Bedingungen übertragen Ihnen keinerlei Eigentumsrechte.

7. Haftungsausschluss für Gewährleistung

DIE APP WIRD OHNE JEGLICHE AUSDRÜCKLICHE ODER STILLSCHWEIGENDE GEWÄHRLEISTUNG „WIE BESEHEN" UND „WIE VERFÜGBAR" BEREITGESTELLT. IM GESETZLICH ZULÄSSIGEN UMFANG SCHLIESST Soft37 AUSDRÜCKLICH ALLE GEWÄHRLEISTUNGEN AUS, EINSCHLIESSLICH DER STILLSCHWEIGENDEN GEWÄHRLEISTUNG DER MARKTGÄNGIGKEIT, EIGNUNG FÜR EINEN BESTIMMTEN ZWECK UND NICHTVERLETZUNG VON RECHTEN DRITTER. WIR GARANTIEREN NICHT, DASS DIE APP UNUNTERBROCHEN, FEHLERFREI, SICHER ODER FREI VON VIREN ODER ANDEREN SCHÄDLICHEN KOMPONENTEN IST.

8. Haftungsbeschränkung

IM GESETZLICH ZULÄSSIGEN UMFANG HAFTET Soft37 NICHT FÜR MITTELBARE, ZUFÄLLIGE, BESONDERE, FOLGE- ODER STRAFSCHADENERSATZFORDERUNGEN, EINSCHLIESSLICH DATENVERLUST, DATENPANNEN, DIENSTUNTERBRECHUNGEN, DURCH DIENSTFEHLER VERURSACHTE WIRTSCHAFTLICHE ODER IMMATERIELLE SCHÄDEN ODER ENTGANGENE GEWINNE UND GESCHÄFTSMÖGLICHKEITEN — SELBST WENN AUF DIE MÖGLICHKEIT SOLCHER SCHÄDEN HINGEWIESEN WURDE. UNSERE GESAMTHAFTUNG GEGENÜBER IHNEN FÜR ALLE ANSPRÜCHE IM ZUSAMMENHANG MIT DER APP ÜBERSTEIGT NICHT DEN BETRAG, DEN SIE UNS IN DEN ZWÖLF (12) MONATEN VOR DEM ANSPRUCH GEZAHLT HABEN.

9. Schadloshaltung

Sie stimmen zu, Soft37 von allen Ansprüchen, Haftungen, Schäden, Urteilen, Verlusten und Kosten (einschließlich angemessener Anwaltsgebühren) freizustellen, zu verteidigen und schadlos zu halten, die aus (a) Ihrer Nutzung oder missbräuchlichen Verwendung der App, (b) Ihrem Verstoß gegen diese Bedingungen oder (c) Ihrer Verletzung von Rechten Dritter entstehen.

10. Anwendbares Recht und Streitbeilegung

Diese Bedingungen unterliegen dem anwendbaren Recht. Streitigkeiten, die nicht durch gutgläubige Verhandlungen beigelegt werden können, werden einem verbindlichen Schiedsverfahren unterworfen, wobei jede Partei einstweiligen Rechtsschutz bei einem zuständigen Gericht beantragen kann. Die maßgebliche Sprache für die Auslegung dieser Bedingungen ist Englisch.

11. Änderungen der Bedingungen

Wir behalten uns das Recht vor, diese Bedingungen jederzeit zu ändern. Wesentliche Änderungen werden durch die Veröffentlichung aktualisierter Bedingungen mit neuem Datum in der App oder per E-Mail mitgeteilt. Die weitere Nutzung nach dem Datum gilt als Zustimmung zu den überarbeiteten Bedingungen.

12. Kündigung

Wir behalten uns das Recht vor, Ihren Zugang zur App jederzeit mit oder ohne Angabe von Gründen und mit oder ohne Vorankündigung zu sperren oder dauerhaft zu beenden. Nach Beendigung erlischt Ihre Lizenz zur Nutzung der App sofort. Die Abschnitte 6–10 bleiben nach Beendigung in Kraft.

Términos de Servicio

Estos Términos de Servicio ("Términos") rigen su acceso y uso de Soft37, desarrollada y operada por Soft37. Al descargar, instalar o usar la App, usted acepta estar sujeto a estos Términos. Si no está de acuerdo, no use la App.

1. Concesión de Licencia

Sujeto a su pleno cumplimiento de estos Términos, Soft37 le otorga una licencia limitada, no exclusiva, intransferible y revocable para instalar y usar la App en dispositivos que usted posea o controle, únicamente para sus propósitos personales y no comerciales.

2. Restricciones de Licencia

Usted no puede, ni puede permitir que otros:

  • Copien, modifiquen, distribuyan, vendan, sublicencien o arrienden cualquier parte de la App o su contenido
  • Realicen ingeniería inversa, desensamblen, descompilen o intenten extraer el código fuente de la App
  • Eliminen, oculten o alteren cualquier aviso de derechos de propiedad dentro de la App
  • Usen la App para crear un producto o servicio competidor
  • Utilicen herramientas automatizadas (bots, scrapers) para acceder a los sistemas o APIs de la App sin consentimiento expreso por escrito

3. Obligaciones del Usuario y Conducta Prohibida

Usted se compromete a usar la App únicamente para fines lícitos. Las siguientes conductas están estrictamente prohibidas:

  • Intentar hackear, penetrar o interrumpir los servidores, la infraestructura o la red de la App
  • Acceder o intentar acceder a cuentas, datos o sistemas de otros usuarios sin autorización
  • Transmitir virus, malware, ransomware o cualquier otro código dañino
  • Participar en fraude, suplantación de identidad, phishing o cualquier forma de falsedad
  • Eludir, deshabilitar o interferir con cualquier función de seguridad o control de acceso
  • Usar la App de cualquier manera que pueda dañar, sobrecargar o deteriorar su funcionalidad

La violación de estas restricciones puede resultar en la suspensión inmediata o la terminación permanente de su cuenta sin previo aviso, a nuestra sola discreción.

4. Suscripción y Pago

Ciertas funciones de la App requieren una suscripción de pago. Todas las compras y suscripciones se procesan exclusivamente a través de Apple App Store o Google Play Store (la "Tienda"), según su plataforma.

  • Los precios, intervalos de facturación y condiciones de prueba gratuita se muestran en la App y en la página de la Tienda correspondiente.
  • Las suscripciones se renuevan automáticamente a menos que se cancelen al menos 24 horas antes del final del período de facturación actual.
  • Puede administrar y cancelar su suscripción en cualquier momento a través de la configuración de su Apple ID o cuenta de Google.
  • No procesamos, manejamos ni almacenamos ninguna información de pago o facturación; todos esos datos son gestionados exclusivamente por la Tienda correspondiente.
  • Los precios de suscripción pueden variar según la región y están sujetos a cambios según las políticas de la Tienda.

5. Política de Reembolso

Todas las solicitudes de reembolso deben presentarse directamente en Apple App Store o Google Play Store de acuerdo con sus respectivas políticas de reembolso. No podemos procesar reembolsos directamente. Al realizar una compra, usted reconoce y acepta que la elegibilidad para reembolso es determinada exclusivamente por la Tienda correspondiente.

6. Propiedad Intelectual

La App y todos sus contenidos, funciones, software, textos, gráficos, logotipos y audio son propiedad exclusiva de Soft37 y están protegidos por las leyes de propiedad intelectual aplicables. Estos Términos no le transfieren ningún derecho de propiedad.

7. Exclusión de Garantías

LA APP SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD", SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS. EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE, Soft37 RENUNCIA EXPRESAMENTE A TODAS LAS GARANTÍAS, INCLUYENDO LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN PROPÓSITO PARTICULAR Y NO INFRACCIÓN. NO GARANTIZAMOS QUE LA APP SEA ININTERRUMPIDA, SIN ERRORES, SEGURA O LIBRE DE VIRUS U OTROS COMPONENTES DAÑINOS.

8. Limitación de Responsabilidad

EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE, Soft37 NO SERÁ RESPONSABLE DE NINGÚN DAÑO INDIRECTO, INCIDENTAL, ESPECIAL, CONSECUENTE O PUNITIVO, INCLUYENDO PÉRDIDA DE DATOS, VIOLACIONES DE SEGURIDAD, INTERRUPCIONES DEL SERVICIO, DAÑOS ECONÓMICOS O MORALES RESULTANTES DE ERRORES DEL SERVICIO, O PÉRDIDA DE GANANCIAS U OPORTUNIDADES DE NEGOCIO — INCLUSO SI SE HA INFORMADO DE LA POSIBILIDAD DE DICHOS DAÑOS. NUESTRA RESPONSABILIDAD TOTAL HACIA USTED NO EXCEDERÁ EL MONTO TOTAL QUE NOS HAYA PAGADO EN LOS DOCE (12) MESES ANTERIORES A LA RECLAMACIÓN.

9. Indemnización

Usted acepta indemnizar, defender y mantener indemne a Soft37 frente a cualquier reclamación, responsabilidad, daño, sentencia, pérdida, costo y gasto (incluidos honorarios legales razonables) que surja de: (a) su uso o mal uso de la App; (b) su incumplimiento de estos Términos; o (c) su violación de derechos de terceros.

10. Ley Aplicable y Resolución de Disputas

Estos Términos se rigen por la ley aplicable. Las disputas que no puedan resolverse mediante negociación de buena fe se someterán a arbitraje vinculante, excepto que cualquiera de las partes podrá solicitar medidas cautelares ante un tribunal competente para evitar daños irreparables. El idioma prevalente para la interpretación legal de estos Términos es el inglés.

11. Cambios en los Términos

Nos reservamos el derecho de modificar estos Términos en cualquier momento. Le notificaremos los cambios materiales publicando los Términos actualizados con una nueva fecha de vigencia en la App o por correo electrónico. El uso continuado de la App después de la fecha de vigencia constituye su aceptación de los Términos revisados.

12. Terminación

Nos reservamos el derecho de suspender o terminar permanentemente su acceso a la App en cualquier momento, con o sin causa y con o sin previo aviso. Tras la terminación, su licencia para usar la App cesa de inmediato. Las secciones 6 a 10 sobreviven a la terminación.

Les présentes Conditions d'Utilisation (« Conditions ») régissent votre accès à Soft37 et son utilisation, développée et exploitée par Soft37. En téléchargeant, installant ou utilisant l'Application, vous acceptez d'être lié par ces Conditions. Si vous n'êtes pas d'accord, n'utilisez pas l'Application.

1. Octroi de Licence

Sous réserve de votre pleine conformité aux présentes Conditions, Soft37 vous accorde une licence limitée, non exclusive, non transférable et révocable pour installer et utiliser l'Application sur des appareils que vous possédez ou contrôlez, uniquement à des fins personnelles et non commerciales.

2. Restrictions de Licence

Vous n'êtes pas autorisé, et ne pouvez pas permettre à d'autres de :

  • Copier, modifier, distribuer, vendre, sous-licencier ou louer toute partie de l'Application ou de son contenu
  • Procéder à de l'ingénierie inverse, désassembler, décompiler ou tenter d'extraire le code source de l'Application
  • Supprimer, masquer ou modifier tout avis de droits de propriété dans l'Application
  • Utiliser l'Application pour créer un produit ou service concurrent
  • Utiliser des outils automatisés (robots, scrapers) pour accéder aux systèmes ou API de l'Application sans consentement écrit explicite

3. Obligations de l'Utilisateur et Comportements Interdits

Vous vous engagez à utiliser l'Application uniquement à des fins légales. Les comportements suivants sont strictement interdits :

  • Tenter de pirater, pénétrer ou perturber les serveurs, l'infrastructure ou le réseau de l'Application
  • Accéder ou tenter d'accéder aux comptes, données ou systèmes d'autres utilisateurs sans autorisation
  • Transmettre des virus, logiciels malveillants, rançongiciels ou tout autre code nuisible
  • Participer à une fraude, usurpation d'identité, hameçonnage ou toute forme d'acte trompeur
  • Contourner, désactiver ou interférer avec toute fonction de sécurité ou contrôle d'accès
  • Utiliser l'Application de toute manière susceptible d'endommager, surcharger ou altérer ses fonctionnalités

La violation de ces restrictions peut entraîner la suspension immédiate ou la résiliation permanente de votre compte sans préavis, à notre seule discrétion.

4. Abonnement et Paiement

Certaines fonctionnalités de l'Application nécessitent un abonnement payant. Tous les achats et abonnements sont traités exclusivement via l'Apple App Store ou Google Play Store (le « Store »), selon votre plateforme.

  • Les tarifs, intervalles de facturation et conditions d'essai gratuit sont affichés dans l'Application et sur la page du Store correspondant.
  • Les abonnements se renouvellent automatiquement sauf annulation au moins 24 heures avant la fin de la période de facturation en cours.
  • Vous pouvez gérer et annuler votre abonnement à tout moment via les paramètres de votre identifiant Apple ou compte Google.
  • Nous ne traitons, manipulons ni stockons aucune information de paiement ou de facturation ; toutes ces données sont gérées exclusivement par le Store correspondant.
  • Les tarifs des abonnements peuvent varier selon les régions et sont susceptibles d'évoluer conformément aux politiques du Store.

5. Politique de Remboursement

Toutes les demandes de remboursement doivent être soumises directement à l'Apple App Store ou à Google Play Store conformément à leurs politiques de remboursement respectives. Nous n'avons pas la capacité de traiter des remboursements directement. En effectuant un achat, vous reconnaissez et acceptez que l'éligibilité au remboursement est déterminée exclusivement par le Store concerné.

DANS LA MESURE MAXIMALE AUTORISÉE PAR LA LOI APPLICABLE, Soft37 NE SERA PAS RESPONSABLE DES DOMMAGES INDIRECTS, ACCESSOIRES, SPÉCIAUX, CONSÉCUTIFS OU PUNITIFS, Y COMPRIS LA PERTE DE DONNÉES OU LES VIOLATIONS DE DONNÉES, LES INTERRUPTIONS DE SERVICE, LES PRÉJUDICES FINANCIERS OU MORAUX RÉSULTANT D'ERREURS DU SERVICE, OU LA PERTE DE PROFITS OU D'OPPORTUNITÉS COMMERCIALES — MÊME SI Soft37 A ÉTÉ INFORMÉ DE LA POSSIBILITÉ DE TELS DOMMAGES. NOTRE RESPONSABILITÉ TOTALE ENVERS VOUS POUR TOUTES LES RÉCLAMATIONS NE DÉPASSERA PAS LE MONTANT TOTAL QUE VOUS NOUS AVEZ PAYÉ AU COURS DES DOUZE (12) MOIS PRÉCÉDANT LA RÉCLAMATION.

9. Indemnisation

Vous acceptez d'indemniser, de défendre et de tenir indemne Soft37 contre toute réclamation, responsabilité, dommage, jugement, perte, coût et dépense (y compris les honoraires d'avocat raisonnables) découlant de : (a) votre utilisation ou mauvaise utilisation de l'Application ; (b) votre violation des présentes Conditions ; ou (c) votre violation des droits d'un tiers.

10. Droit Applicable et Résolution des Litiges

Les présentes Conditions sont régies par la loi applicable. Tout litige ne pouvant être résolu par une négociation de bonne foi sera soumis à un arbitrage contraignant, étant entendu que chaque partie peut demander une injonction devant un tribunal compétent pour prévenir un préjudice irréparable. La langue prévalente pour l'interprétation juridique des présentes Conditions est l'anglais.

11. Modifications des Conditions

Nous nous réservons le droit de modifier les présentes Conditions à tout moment. Nous vous informerons des modifications importantes en publiant les Conditions mises à jour avec une nouvelle date d'entrée en vigueur dans l'Application ou par e-mail. La poursuite de l'utilisation de l'Application après cette date vaut acceptation des Conditions révisées.

12. Résiliation

Nous nous réservons le droit de suspendre ou de résilier définitivement votre accès à l'Application à tout moment, avec ou sans motif et avec ou sans préavis. Après résiliation, votre licence d'utilisation de l'Application cesse immédiatement. Les articles 6 à 10 survivent à la résiliation.
